Herring Overrules Past AG Opinions

Attorney General Mark Herring issues an official opinion overruling 58 racially-focused opinions from former Virginia attorneys general that Herring says used the office “to perpetuate injustice.” According to Herring’s office the opinions issued between 1904 and 1967 either interpreted or applied laws that denied Black citizens equal rights, education access and established unconstitutional voting barriers. An attorney general’s formal opinion does not create new laws or amend those on the books, but are seen as analysis of the law or legal advice.
